Enforcement of a 1,2mGBD English Third Party Costs Order
09-12-2024
We successfully represented our client in a case concerning the enforcement of an English Third Party Costs Order (TPCO), culminating in the successful enforcement of the order against the debtor’s Greek assets. During the proceedings, the Piraeus Court of Appeal issued a landmark decision, marking the first published ruling by a Greek court on the contentious issue of recognizing and declaring TPCOs enforceable in Greece. The Court of Appeal, accepting the arguments we advanced, held, among other things, that TPCOs do not violate Greek public policy and ruled that, provided that all other conditions under Greek law are met, TPCOs can be recognized and declared enforceable in Greece.
